Correct, you are. Not too mention the expense of continued therapy and the time you miss from your job or any other situation that arises. Forget about the trouble of fixing or getting a new car. Such expenses which are not planned could cause financial ruin to even those families that are prepared.
You could always try to sue the other driver, but in reality it would not be that effective. First, they were driving while uninsured, often because they can't afford the insurance premiums. Secondly, they disregarded the law that states insurance is necessary for one to operate a vehicle. Let's review what we have learned. This individual is not scared of existing laws and likely could not afford to payout a lawsuit in your favor.
Drivers who have had fender benders or tickets are not stopped by removing their licenses or being told that if they don't have insurance, they are not allowed to operate a vehicle. If their intention is to drive, they will, no matter what the consequences are.
An even bigger problem is a driver who is underinsured. You can rest assured that the driver was insured as you exchange information. What if, after the claim adjuster starts, you find that you do not have enough insurance to cover costs? your car is still not repaired, and there is nothing else you can do.
