Loan modification companies have sprung up all over the place since President Obama's Stimulus plan for homeowners has been passed. They claim their service is to help homeowners get mortgage loan modifications from their lenders and save their homes from foreclosure.

While some firms do legitimately help people to get a more affordable monthly payment, many dishonest scam operators are out there taking advantage of vulnerable homeowners. When someone is facing the loss of their home, they are desperately seeking a solution to their dilemma.

When considering using the services of one of these companies, at what areas should you look closely?
· The first thing you want to check is whether they have an office? If they don't, it's a bad sign. If they do have some kind of office, it should not just be a room full of telephones.

· You should be able to examine references of people for whom they have obtained successful loan modifications. You should be able to actually contact some of them. Of course, privacy issues could be involved here, making it a little tricky. That's where family and friend's recommendations come in.

· It is a good sign when they have some legal staff at your disposal.

· If you feel pressured into signing anything through threats or scare tactics of any kind, this is a bad sign. If they claim to have had an ominous discussion with your lender, that is just not true; it does not happen.

· If the loan modification companies try to appear to as a government agency, that is a sure fire sign it is not legitimate. No government agencies are involved in running this type of business. There are government agencies that offer free assistance to homeowners who need help approaching their lender; HUD is who you need to call.

The Treasury Department is providing financial incentives to lenders to do these loan modifications, so they are motivated. If you qualify to apply, you can get a loan modification without the services of loan modification companies. But, lenders are getting besieged with borrowers seeking assistance, and a trained professional with a proven track record could raise your chances of obtaining the mortgage adjustment you need to avoid losing your home.

Take great care to select a company that will not take advantage of your already ailing financial situation. A legitimate company will assist you for a moderate fee, but not take advantage of your desperate situation. Before you even begin, find out more about what qualifications you need to meet to apply.
