Typically, attorneys charge an hourly fee. According to lawyers, plumbers and doctors get paid for their work, so why shouldn't they? No one really thinks the lawyers should not be paid. The real issues are how long payments should be made to the lawyer, and how much they should really charge. Some middle class clients have taken on lifetime payments for legal services rendered during their personal injury lawsuit, divorce proceeding, real estate transaction, and even drafting their Last Will and Testament.

Then there are attorneys who steal the very money that they are supposed to be managing for widows and orphans. Of course, those are the obvious ones, unlike those that rob you by charging large fees for their services. In one case, which took place over five years' time, two legal partners charged over sixty percent of a six figure estate. Having been ruled incompetent by the court, the owner of the estate did not manage his own affairs. The good news in this case was that the lawyers were made to pay back the money they had taken. Another lawyer who had a reputation of being eccentric took them to court over it. No one else would even look at the case.

News stations and newspapers do not help the legal fee problem, and actually almost encourage the shady dealings by behaving as if the court system is not a news source. Local courts make information on how much the guardians and lawyers are paid easily available. Yet, it isn't generally reported. Some of the problem could also be contributed by the bar association itself. They don't want anything to come between the client and lawyer relationship currently in place. If anything negative is presented by the media about the legal profession, the associations quickly make a statement to the contrary.

Even though the lawyer fees are based upon the time the lawyer works the case, the percentage of compensation is usually what the lawyer wants. Plus, the bar associations support attorneys in their insistence of a minimum fee agreement with clients. 9What the percentage arrangement (contingent fee) states is that the lawyer receives a certain percent of the compensation awarded to the client. Most personal injury suits give the lawyer twenty-five to fifty percent of the winnings.

This kind of fee is a purely American creation, just like poker. The majority of Europe disallows percentages such as contingency fees. The first instance of this contingency fee arrangement in the United States was noted in 1848, to assist workers injured while working. Without money to hire an attorney, the injured workers could not file a civil suit to mark their claim.
