One of the more intriguing medical malpractice cases that I have been exposed to involved a lovely English woman who wanted to file a complaint because her plastic surgeon had replaced some of the parts unevenly when he was operating on her breasts. The color photos I had of my client's breasts simply did not do justice to her injury when the time for the trial finally came. As such, I requested permission from the trial judge to present the plaintiff naked to the jury. He assented, and everyone moved to the judge's chambers. My client then removed her top so that everyone could see the damage for themselves.

Surgeons may not have an easy job, but in my field, I've seen breasts completely dessimated by some doctors, and that is not something a jury can fix with a monetary award. I've tried so many cases where the injury to the body needed to be portrayed in court. Putting these injuries on exhibit is sometimes a necessary evil. However, this woman's case was by far the most striking of all my cases that went to court.

Tort is a term of art in the law that has no relationship to tart. Tort hails from an old French word meaning to twist or turn. This seems to be the appropriate word to describe what has happened in these circumstances as the victim or a tort has usually undergone something that has left them bent, broken, and twisted out of shape. But any injury that someone suffers to their mind or body can rightly be called a tort. Medical and legal malpractice cases are based upon personal harms done by those types of professionals. In the end, torts are simple yet complex events that are only limited by a man's ingenuity. Every kind of disaster known to man and every kind of accident known to man all have their own tort. It can also deal with doctors, lawyers, hospitals, and more, as all of these cases, regardless of the situational evidence, pertain to negligence.

Thus, anyone visiting a doctor in a growing number of jurisdictions is likely to receive a document and a request for a signature. This piece of paper will probably require that in order to receive care that you must waive all your court rights, and that any disputes that come up will be dealt with by you and the doctor, or with the assistance of an arbitrator. Of course, some courts recognize these agreements and some don't, but the majority hold them to be invalid. If the arbitration contract restricts your right to pursuing your case in court, it is likely an illegal contract and a violation of your rights.

It isn't legal to force arbitration on anyone, and everyone has the right to a jury. Criminal law as it is considered today was supported heavily through the Chief Justice of the Supreme Court during 1953 to 1969. At that time a lot of the old rights were updated, even older ones were reconstituted, which has made the criminal lawyer quite visible in today's society. Politics is a big area for lawyers in this country. There are some incredibly talented attorneys who gave up the law for a life in politics. The benefit to us as citizens is that these fine men and women are using their talents to write laws and determine their validity.
