In addition, although China has liberalized a great deal in the last several decades, it is a different world in terms of its legal system.

You must remember that China is a work in progress, a nation that is rocketing into the 21st century after, essentially, holding itself back for much of the 20th. As a growing economy brings prosperity to more and more of its citizens, the stranglehold of Communist-era laws and controls is definitely relaxing. However, it is a serious error to think that China is like, say, Europe or the United States in terms of criminal and civil law. It is quite different, even though attempts are being made to bring its justice system into compliance with some world standards. You are well advised to moderate your impulses and find the proper way to do business and communicate with the various government agencies that are involved in regulating foreign investment in China.

Besides the legal differences, there are dramatic cultural differences that come into play in every area - law, business, travel, finance, communication, etc. If you are not presenting yourself in the proper manner, you risk alienating the very people - in government and business, both - whose assistance you will need to succeed in your foreign investments. The best possible solution, of course, is to avail yourself of the services of a Chinese attorney that is fluent in both Chinese and English, knows the culture of both countries, understands what needs to be done and has the experience to guide you through the many intricacies of doing business there.

Broad expertise
Make sure the lawyer you choose has experience in all the areas your investment will impact. There may be more to what you are planning than you even know, and at the very least, your lawyer needs to be up-to-date on international trade, admiralty and maritime law, foreign investment regulations, corporate and commercial laws, litigation, arbitration and financial reporting. If you locate an experienced China lawyer with these abilities, who can also guide you through the cultural maze, you will maximize your chances of success in what will one day (soon) be the world's largest economy.
