Home Defaults And The Divorce Effect

Divorce is never a very easy thing to deal with and it is often made more complex by division of property issues and other ongoing debts that have been accrued- but what happens if you divorce and the spouse that gets the home defaults? You could be harassed by creditors, regardless of your divorced status. That is just what happened to Kristy Sinsara, age 28 of Las Vegas, Nevada found out. The emotionally crushing divorce followed by the creditor harassment threw her for a loop- she never realized that when her ex husband got the house, that she was going to have to deal with it again, but the past came back to haunt her. For Kristy Sinsara, this was a lesson in looking before you leap- or rather, making sure you know about the contracts that may follow you even once the ink on your divorce is dry.

When the first call came to Kristy Sinsara, she thought that it was surely some sort of mistake. There had to be something wrong here, after all, the divorce decree awarded him the house- how could these creditors be saying that her credit would be impacted by this? It didn't seem fair or right but Sinsara soon found out that it was right- she was obligated to deal with this as both of their names were on the contract. "The creditor began calling me pretty much all hours of the day for a home I was not even living in, or in possession of- it was a real night mare that I never anticipated and really was not sure how to deal with". Fortunately, a friend enabled her to take a good look at the options out there for her and she was able to find a resolution to the issue.

Kristy Sinsara's solution to the problem, as it turns out was a refinance- however, she took possession of the home as her ex husband could not keep up with the payments. There was a modification made to the original agreement and once Kristy Sinsara was able to do so, she sold the house so that she could finally have her life back. "It was a disturbing thing, I thought that everything had been taken care of and then to have this come back to bite me like that, I just never expected it" Sinsara told us. "It is really something else, but you learn really fast that the divorce decree only really applies to the marriage- not anything else. So if you have some sort of mutual debt in your marriage, if you're thinking about a divorce that may be something you want to consider. I didn't- and ended up with a serious pain in the neck." Fortunately for Kristy Sinsara, she was able to resolve this, but she has since really had a new policy of always making sure she knows exactly what is going on with every piece of paper and debt she gets into.
