In the United States there is a different statute in every state for wrongful deaths, but it is common in all the states that a lawsuit can be brought forward for damages in a wrongful death situation.

A wrongful death is caused by the misconduct or negligence of another person, a third party, employer, another company, or any other entity. A lawsuit can be brought about for compensation by the immediate relatives of the deceased or the executor or administrator of the estate of the deceased.

The immediate relatives include spouses, children, and in some cases parents and siblings. Some states stipulate that suits for damages for wrongful deaths can be brought about only by a personal representative of the decedent's estate.

Laws in the United State permit monetary compensation for emotional and financial losses due to wrongful deaths for the immediate relatives of the deceased. Damages can be claimed for loss of future companionship and mental anguish, and loss support and comfort.

Other things that can be claimed include loss of services that have a monetary value, cost of medical expenses of the deceased prior to death, and funeral expenses. There's also a things called survival damages, which are damages the decedent would have recovered had he or she survived. Last, but not least, is the pain and suffering the decedent would have suffered prior to their untimely death.

One can file a wrongful death action for medical malpractice for a car accident which results in death, a boating accident, or abuse and neglect on the part of the staff in a nursing home. Even a defect in the manufacture of a prescribed medicine used by the dead which caused the death can give just cause.

Compensation depends on many factors. The age and the total income earned, including that earned outside the regular employment are taken into consideration. For a deceased person in a higher income bracket, the compensation granted is higher. Likewise, the compensation obtained for the death of a younger person is higher than that of an older person, provided other conditions remain the same.

The state or relationship of the spouse with the dead has also a bearing on the amount of the compensation. A recently separated spouse may get a lesser compensation than a just married one. Compensation for wrongful deaths of children also comes under the purview of these laws. But compensation for such claims are lower than those for adults because children have very little or no capacity for earning.

There are limitations for claims for compensation in many of the states. In all states a time limit is fixed under the law. After the time allowed for making a claim elapses, the heirs are not permitted to sue for claim. Further, limits of compensation are set in several states.
